MyDealXP Privacy Policy

Advanced Auto Dealers, Inc. ("Advanced Auto Dealers," "MyDealXP," "we," "us," or "our") operates the MyDealXP mobile application, website, and related services (collectively, the "Service"). This Privacy Policy explains what information we collect, how we use and disclose it, and the choices available to you.

By using the Service, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, do not use the Service.

1. Information We Collect

Information you provide

Depending on how you use MyDealXP, you may provide:

• Account and profile information, such as your name, email address, telephone number, profile photograph, business or dealership information, job-related information, login credentials, and account role or status.
• Communications and user content, including direct and group messages, photographs, attachments, reactions, notes, and other content you choose to send or store through the Service.
• Relationship, invitation, and contact information, such as invitation codes and links, QR-code connection information, connection status, and information you enter about people you invite. MyDealXP does not currently access or upload your device's contact list.
• Deal and vehicle-related information, including vehicle details, pricing or price ranges, deal status, buying preferences, saved vehicles, customer-provided vehicle information, and related notes or content.
• Subscription and transaction information, such as your selected plan, subscription status, billing history, and limited transaction records. Payments are processed by Stripe. We do not receive or store your full payment-card number or card security code.
• Support and feedback information, including messages, screenshots, diagnostic details, and other information you submit when requesting assistance or providing feedback.

Information collected automatically

When you use the Service, we and our service providers may automatically collect:

• Device and app information, such as device type, operating system, app version, language, and device or app identifiers.
• Usage information, such as features used, screens viewed, actions taken, dates and times of access, and interactions with notifications.
• Log and security information, such as Internet Protocol (IP) address, request and error logs, authentication events, and information used to detect abuse, fraud, or security incidents. An IP address may reveal an approximate geographic area, but MyDealXP does not currently collect precise GPS location.
• Push-notification information, including a device push token and notification delivery or interaction status.
• Cookies and similar technologies on MyDealXP websites, if applicable, for essential operation, security, preferences, and measurement.

Camera and photo access

With your permission, MyDealXP may access your device's camera or selected photos so you can scan QR codes, take or select photographs, attach media, and submit feedback. MyDealXP does not collect your entire photo library merely because you grant access. You can change camera and photo permissions through your device settings, although doing so may prevent certain features from working.

2. How We Use Information

We use information to:

• create, authenticate, maintain, and secure accounts;
• provide messaging, invitations, connections, deal sharing, vehicle-related features, media uploads, and other Service functionality;
• process subscriptions and maintain billing status;
• send transactional emails, service messages, push notifications, security alerts, and support responses;
• personalize and improve the Service and understand how its features are used;
• diagnose errors, maintain reliability, prevent spam, fraud, abuse, and unauthorized access, and enforce our terms and policies;
• comply with applicable law, respond to lawful requests, and protect the rights, safety, and property of users, Advanced Auto Dealers, and others; and
• establish, exercise, or defend legal claims.

We do not sell personal information. We do not use personal information for cross-context behavioral advertising or track users across unrelated apps and websites for advertising.

3. How We Disclose Information

We may disclose information in the following circumstances:

At your direction and to other users

MyDealXP is a relationship and communications service. Information you place in your profile or intentionally send, share, or make available through a connection, conversation, group, invitation, or deal may be visible to the relevant users. Recipients may save, copy, or further disclose information they receive, so you should share only information you are comfortable providing to them.

Service providers

We disclose information to vendors that process it for us to provide and protect the Service. These providers may include:

• Amazon Web Services, for cloud infrastructure, data hosting, backups, and media storage;
• Stripe, for subscription billing and payment processing;
• Apple and Google, for app distribution, operating-system services, and push-notification delivery;
• providers of transactional email, customer support, security, monitoring, and technical infrastructure; and
• analytics or crash-reporting providers if we later enable those services.

These providers may process information only as permitted by their agreements with us and their own applicable privacy notices. We will update our disclosures and applicable app-store privacy information if our data practices or material service providers change.

Legal, safety, and business reasons

We may disclose information when we reasonably believe disclosure is necessary to comply with law or valid legal process; investigate or prevent fraud, abuse, or security threats; enforce our agreements; protect rights, property, or safety; or respond to an emergency.

If Advanced Auto Dealers is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be disclosed to advisers and transaction participants and transferred as part of that transaction, subject to applicable law.

4. Data Retention

We retain personal information for as long as reasonably necessary to provide the Service, maintain your account, fulfill the purposes described in this policy, comply with legal and accounting obligations, resolve disputes, enforce agreements, and protect the Service and its users.

Retention periods depend on the type of information and why it was collected. For example, we may retain account and user content while an account is active; transaction records for legally required accounting or tax periods; and security logs for a limited period appropriate to investigate abuse and protect the Service. Backup copies may remain for a limited period until they are overwritten or securely deleted.

When information is no longer needed, we will delete, de-identify, or aggregate it, subject to applicable legal and technical limitations.

5. Account Deletion and Your Choices

You may update certain profile information and notification preferences within MyDealXP. You can also control camera, photo, and notification permissions through your device settings.

You may request deletion of your MyDealXP account and associated personal information through the account settings in the app or through the account-deletion page on the MyDealXP website. You may also contact us at privacy@mydealxp.com.

When we complete an account-deletion request, we delete or de-identify personal information associated with the account unless retention is reasonably necessary for legal compliance, security, fraud prevention, dispute resolution, financial recordkeeping, or another lawful purpose. Information you shared with another user may remain accessible to that recipient or be retained in de-identified form where necessary to preserve the integrity of conversations and records. We may ask you to verify your identity before processing a privacy request.

You may opt out of nonessential communications by using an unsubscribe link where provided. You may disable push notifications in your device settings. We may still send essential account, security, billing, or service-related communications.

6. State Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have rights to request access to, correction of, deletion of, or a portable copy of personal information; to learn about how we process and disclose personal information; and to appeal a decision concerning a privacy request.

MyDealXP does not sell personal information or process it for targeted advertising as those terms are defined under applicable U.S. state privacy laws. We will not discriminate against you for exercising an applicable privacy right.

To submit a request or appeal, email privacy@mydealxp.com. Please state that your request concerns MyDealXP and describe the right you wish to exercise. We may need to verify your identity and may deny or limit a request where permitted by law. An authorized agent may submit a request where applicable, but we may require proof of authorization and identity verification.

7. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encrypted transmission where appropriate, access controls, restricted service credentials, and security monitoring. No system, network, or storage method is completely secure, and we cannot guarantee absolute security.

You are responsible for protecting your login information and for promptly notifying us if you suspect unauthorized access to your account.

8. Children's Privacy

MyDealXP is intended only for individuals who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we learn that an individual under 18 has provided personal information through the Service, we will take reasonable steps to delete the information and close the account. If you believe a person under 18 is using MyDealXP, contact us at privacy@mydealxp.com.

9. Third-Party Services and Links

The Service may contain links to third-party websites or services. We do not control and are not responsible for the privacy practices of third parties acting independently from us. Review their privacy notices before providing information to them.

10. Processing and Storage in the United States

MyDealXP is operated from the United States. If you use the Service from another country, your information may be processed and stored in the United States or other countries where our service providers operate. Those countries may have data-protection laws different from the laws where you live.

11. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to the Service, our practices, or applicable law. We will post the updated policy and revise the effective date. If a change is material, we will provide additional notice when required, such as through the Service, by email, or by another appropriate method.
